These Terms & Conditions (the “Terms”) govern your access to and use of InsuranceDownPayment.com and any forms, content, communications, or services made available through the website (collectively, the “Site”). The Site is operated by CIDPF, which is wholly owned by Sunset Factoring Partners LLC (“CIDPF,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Commercial-purpose services only

CIDPF provides information and consulting related to potential commercial insurance down payment financing for businesses. The Site is intended for business and commercial purposes. It is not intended to offer personal, family, or household consumer financing.

2. CIDPF is not a lender or insurance company

CIDPF is not a direct lender, bank, insurance company, insurance agency, or insurance broker, and CIDPF does not provide insurance, legal, tax, accounting, or investment advice. Financing, if available, is offered through independent participating funding providers. Any funding provider may establish its own eligibility standards, underwriting requirements, rates, fees, documentation requirements, and terms.

3. No commitment, guarantee, or approval

Submitting a form, providing documents, communicating with CIDPF, or receiving an estimate or discussion does not constitute an approval, commitment to lend, offer of credit, or guarantee of funding. Funding availability and terms may change at any time and are subject to review and final approval by participating funding providers.

4. Your information and authority

You agree that information you provide is accurate and complete to the best of your knowledge and that you are authorized to provide it on behalf of the business identified in your submission. You may not use the Site to impersonate another person, submit fraudulent information, interfere with the Site, attempt unauthorized access, or use the Site for unlawful purposes.

5. Electronic communications

By submitting a form, you consent to receive communications relating to your inquiry by email and, where you provide appropriate consent, by telephone or SMS/text message. Electronic communications may include information about your inquiry, application status, requested documentation, scheduling, and available services.

6. SMS/Text Messaging Terms

If you affirmatively opt in to SMS/text messaging, you authorize CIDPF to send recurring informational and marketing text messages to the mobile number you provide, including messages sent using automated technology where applicable. Consent is not a condition of obtaining financing or other services. Message frequency varies. Message and data rates may apply.

You may revoke SMS consent at any time by replying STOP to a message or by contacting us using the information below. You may reply HELP for assistance. We may send one final confirmation message after an opt-out request. Carriers are not liable for delayed or undelivered messages.

7. Third-party services and providers

The Site may link to or use third-party services, including participating funding providers, form-processing services, scheduling services, analytics providers, and other technology vendors. CIDPF does not control third-party websites or services and is not responsible for their content, availability, security, privacy practices, decisions, or performance. Your use of a third-party service may be governed by that third party’s terms and privacy policy.

8. Intellectual property

The Site, including its text, graphics, logos, design, and other original content, is owned by or licensed to CIDPF and is protected by applicable intellectual-property laws. You may use the Site for legitimate business evaluation and informational purposes, but may not copy, republish, distribute, reverse engineer, or exploit Site content without written permission, except as permitted by law.

9. Website availability and security

We may change, suspend, restrict, or discontinue any part of the Site at any time. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of harmful components. You are responsible for using reasonable security measures on your own devices and accounts.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RESULTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIDPF, SUNSET FACTORING PARTNERS LLC, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, BUSINESS, OR OPPORTUNITY; OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, RELIANCE ON SITE CONTENT, THIRD-PARTY SERVICES, FUNDING DECISIONS, OR INSURANCE-RELATED DECISIONS. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless CIDPF and Sunset Factoring Partners LLC from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Site, material breach of these Terms, or submission of information you were not authorized to provide.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. To the extent permitted by applicable law, disputes relating to the Site will be brought in a state or federal court with jurisdiction in or serving Broward County, Florida.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above identifies the most recent revision. Continued use of the Site after an update constitutes acceptance of the revised Terms to the extent permitted by law.
